B. A person who intends to engage in short-term profit-making activities under various service contracts, etc. for the purpose of installation, maintenance, repair of machinery, etc., production and supervision of shipbuilding and industrial facilities, etc. by being dispatched to public institutions or private organizations in korea.

C. A person recognized by the Minister of Justice as someone who intends to engage in short-term employment activities in the fields of crop cultivation and harvesting (including raw processing related to cultivation and harvesting) and raw processing of marine products, as determined by the Minister of Justice in consultation with the heads of relevant central administrative agencies.

Study

A person who wants to receive regular education or conduct specific research at an educational institution higher than a junior college or an academic research institute(ex: Associate, Bachelor's, Master's or Doctoral Degree / Research Study / Exchange Student)

Industrial Trainee

A person who satisfies the training conditions set by the Minister of Justice and wishes to receive training at a Korean industry.

Language or General Trainee / Student

A person who intends to receive education or training or engage in research activities at an educational institution, company, or organization that meets the requirements set by the Minister of Justice (Those who receive remuneration exceeding the cost of stay from a training institution or who are eligible for Study visa(D-2) or Industrial Trainee visa(D-3) status are excluded).

D-5

Long-term Reporting

A person who is dispatched by a foreign newspaper, broadcasting company, magazine or other news agency, or is stationed in Korea under a contract with a foreign news agency and intends to conduct reporting or reporting activities.

Religious Worker

A. A person who dispatched from a foreign religious organization or social welfare organization and plans to engage in religious activities at a branch or related religious organization in Korea.

B. A person who intends to engage in social welfare activities upon invitation from a religious organization or social welfare organization in Korea

C. Any other person who intends to engage in religious activities or social welfare activities recognized by the Minister of Justice

D-7

Expatriate

A. A person who has worked at the head office, branch, or other business office of a foreign public institution, organization, or company for more than one year and who intends to be dispatched as an essential professional to its affiliate, subsidiary, branch, or office in Korea.
[Persons who meet the corporate investment (D-8) status of residence are excluded, and the one-year or more work requirement does not apply in cases where the person intends to engage in national key industries or national projects, or in other cases deemed necessary by the Minister of Justice.]

B. A person who has worked over one year at overseas local corporation or overseas branch established by a listed corporation(under Article 9, Paragraph 15, Item 1 of the Financial Investment Services and Capital Markets Act*) or A public institution(under Article 4, Paragraph 1 of the Act on the Management of Public Institutions*) and intends to provide or receive specialized knowledge or skills by dispatched to the headquarters or head office in Korea.
(Excluding cases where the head office's investment amount in an overseas local corporation or overseas branch of a listed corporation is less than USD 500,000)

D-8

Corporate Investment

A. Persons recognized by the Minister of Justice as essential professional personnel who intend to engage in the management/production/technology fields of foreign-invested companies pursuant to the Foreign Investment Promotion Act.
[excluding persons who have invested in companies(except corporation) managed by foreigners and have been hired in Korea]

B. Among those who have established a venture business pursuant to Article 2-2 (1) 2 (c) of the Act on Special Measures for the Promotion of Venture Businesses with excellent technical capabilities, such as holding intellectual property rights, a person who has been confirmed as a venture business pursuant to Article 25 of the same Act
Or a person equivalent to this and recognized by the Minister of Justice

C. A person who falls under any of the following and holds intellectual property rights or possesses equivalent technical skills, and is a corporate founder recognized by the Minister of Justice.
1) A person who has obtained an associate's degree or higher in Korea
2) A person who has obtained a bachelor's degree or higher from a foreign country
3) A person recommended by the head of the relevant central administrative agency as someone who possesses excellent technical skills, including intellectual property rights.

International Trade or Business

A person who intends to establish and manage a company in the Republic of Korea or engage in activities for trade or other profit-making businesses and is considered essential professional
[including a person who intends to work dispatched by Public Institution/Private Organization in Korea for the installation and repair of imported machinery, etc., and the production and supervision of shipbuilding and industrial facilities, etc.]

Job Seeker or Startup

A. a person who intends to engage in training or job-seeking activities, etc. in the fields from E-1 visa to E-7 and recongnized by the Minister of Justice.

Professor

A foreigner who meets the qualification requirements under Article 14 (1), (2) or Article 17 of the Higher Education Act* and intends to engage in education or research/instruction activities in a specialized field at a junior college or higher educational institution or an equivalent institution.

E-2

Foreign Language Instructor

A foreigner who meets the qualifications determined by the Minister of Justice and wishes to engage in foreign language conversation instruction at a foreign language academy, an elementary school or higher educational institution, an affiliated language research institute, a language training center affiliated with a broadcasting company or a company, or other equivalent institutions or organizations.

Researcher [Excluding Professor(E-1)]

A person who has been invited by a public institution or private organization in Korea and wishes to engage in research in the field of natural science, social science, humanities, arts, sports, advanced industrial technology at various research institutes

Technical Instructor / Technician

A person who is invited by a public institution or private organization in Korea to provide specialized knowledge in the field of natural science or technology belonging to a special industrial field.

Professional [Excluding Professor(E-1)]

A foreign lawyer, certified public accountant, doctor, or other person with nationally recognized qualifications recognized under the laws of Korea who wishes to engage in professional work such as law, accounting, or medical treatment that is permitted under the laws of Korea

Artist

A person who wants to engage in profit-making artistic activities such as music, art, and literature, as well as profit-making entertainment, performance, theater, sports, advertising/fashion modeling, and other similar activities.

Employee in Specific Work

A person who intends to engage in activities specifically designated by the Minister of Justice pursuant to a contract with a public institution, private organization, etc. in Korea

Seasonal Worker

A person recognized by the Minister of Justice as someone who intends to engage in employment activities in the fields of crop cultivation and harvesting (including raw processing related to cultivation and harvesting) and raw processing of marine products, as determined by the Minister of Justice in consultation with the heads of relevant central administrative agencies.

Non-Professional

Persons who meet the domestic employment requirements pursuant to the Act on Employment of Foreign Workers, etc. (excluding persons who wish to engage in professional occupations that require certain qualifications or experience, etc.)

Ship Crew

A person who falls under any of the following items and is a foreigner who has entered into a seafarer employment contract on the condition that he/she will provide labor for more than six months at the business, and who is a member under Article 2, Paragraph 6 of the Seafarers Act.

A. A person who runs a business under Article 3, Subparagraph 1, 2, or 5 or Article 23, Subparagraph 1 of the Shipping Act

B. A person who runs a business under Article 7 (1) 1, Article 40 (1), or Article 51 (1) of the Fisheries Act.

C. A person who is a national cruise business operator pursuant to Article 2, Paragraph 7 of the Act on the Promotion and Support of the Cruise Industry and who operates a business using an international cruise ship pursuant to Paragraph 4 of the same Article

F-1

Family Visitor

A. A person recognized by the Minister of Justice as a person who intends to stay for purposes such as visiting relatives, living with family, becoming a dependent, reorganizing the household, or other similar purposes.

B. A domestic helper of a person who falls under any of the following:
1) Persons with (A-1) or (A-2) visa
2) A foreign investor (including its executives and employees in the case of a corporation) who has invested more than US$500,000, including Corporate Investment (D-8), Residence (F-2), Permanent Residence (F-5), and Marriage Migrant (F-6)
3) A foreign investor (D-8. including its executives and employees in the case of a corporation) who has invested in cutting-edge and information technology companies determined by the Minister of Justice, such as artificial intelligence (AI), information technology (IT), electronic commerce, e-business, biological industry (BT), and nanotechnology (NT) fields, Residence (F-2), Permanent Residence (F-5), or Marriage Migrant (F-6).
4) Persons who with Long-term Reporting (D-5), Expatriate (D-7), International Trade or Business (D-9), from Professor (E-1) to Employee in Specific Work (E-7),
Or foresaid persons who recognized by the Minister of Justice as a professional who has changed his/her visa with non Diplomat over 5 year legal residence(F-2-F) or Permanent Residence (F-5-A).

C. A person who does not belong to the same household as a person with Diplomat (A-1) to Agreement (A-3), and who is recognized by the Minister of Justice as being necessary for such stay.

D. Any other person who is deemed to have circumstances that require him or her to stay in Korea for a long period of time without engaging in professional activities due to unavoidable reasons.

F-2

Residence

A. Minor foreign children of citizens or the spouse and minor children of a person with Permanent Residence (F-5) visa.

B. A person recognized by the Minister of Justice as a person born out of a marriage relationship (including a de facto marriage relationship) with a citizen.

C. A person recognized as a refugee

D. A foreign investor, etc. under the Foreign Investment Promotion Act who falls under any of the following:
1) A foreigner who has invested more than US$500,000 and has stayed in Korea for more than 3 years with corporate investment (D-8) visa
2) A person who has been dispatched to a foreign-invested company in Korea under the Foreign Investment Promotion Act by a foreign corporation that has invested more than US$500,000 and has stayed there for more than 3 years.
3) A foreigner who has invested more than US$300,000 and employs two or more Koreans

E. Among those who have lost their permanent resident (F-5) visa, those who the Minister of Justice deems necessary to continue staying in Korea in consideration of the protection of rights and interests (excluding those who have been forcibly evicted)

F. A person recognized by the Minister of Justice as a person who has stayed in Korea for more than 5 years with legal residence other than Diplomat (A-1) to Agreement (A-3)

H. A person recognized by the Minister of Justice as a person appointed as a public official pursuant to the National Public Officials Act or the Local Public Officials Act

I. A person whose age, education, income, etc. meets the standards set and announced by the Minister of Justice

J. A foreigner recognized by the Minister of Justice as a person who has invested in assets such as real estate or as an executive or shareholder of a corporation in accordance with the standards set and announced by the Minister of Justice, such as investment area, investment target, and investment amount. In this case, for corporations, the Minister of Justice determines the number of people eligible for Residence Status in consideration of the investment amount, etc.

K. A person recognized by the Minister of Justice as having made a special contribution to Korea or contributing to the advancement of public interest

L. Spouses and children of persons falling under above items as I, J, K (only applicable to children who meet the requirements set by the Minister of Justice)

M. A person who meets the standards notified by the Minister of Justice, taking into account of the target industry/region/residence/employment status in the area and period of time, etc., in order to support the supply and demand of manpower and the restoration of regional vitality in areas with declining populations pursuant to Article 2, Paragraph 12 of the Special Act on Local Autonomy and Decentralization and Balanced Regional Development.

Dependent

A person who is a spouse or minor child(does not have a spouse) of a person with from (D-1) visa to (E-7) visa, Residence (F-2), Overseas Koreans (F-4) and Work and visit (H-2).
Excluding a person who fall under the other categories of residency (F-2-L) is excluded.

Overseas Korean

A person who falls under Article 2, Paragraph 2 of the Act on the Immigration, Entry, and Legal Status of Overseas Koreans*

Marriage Migrant

※ General Requirements

1. Good attitude, such as compliance with laws and regulations

excludes:

- In Korea a person who:

· Sentenced to Violent Crimes (murder, kidnapping, abduction, human trafficking, rape, robbery, organizing a criminal group)

· Within 5 years from the date of completion or exemption from punishment(imprisonment or heavier punishment)

· Sentenced to probation of imprisonment or heavier punishment and within 5 years from the date of confirmation

· Within 3 years from the date of paying the fine sentenced

· Within 5 years from the date of violation of passport/visa/entry permit

· Has violated the Immigration Control Act three or more times in the past five years from the date of application (excluding Administrative Fine)

· Within 7 years after leaving Korea with a Deportation Order / Within 5 years after leaving Korea with a departure order

· In the past 3 years for violation of the Immigration Control Act, fined more than 5 million KRW in one case or has received a total fine of more than 7 million KRW in few cases

· Sentenced for Violent Crimes, Intimidation, Blackmail, Fraud, Drunk Driving more than three times, Voice Phishing, or Drug crimes

g. Has stayed legally in Korea for more than 10 years by the date of application

h. Has Difficulty to issue documents due to not meeting the age/residence requirements in the country of residence, though you have stayed for more than 6 months there

2. Livelihood Requirements (in case of F-5-10 or F-5-13, only the applicant is considered as the income earner. You must meet income or asset requirements.)

- Among the applicant and family members(spouse(excluding common-law marriage), minor children, parents(excluding the spouse's parents)), a person who continues to live with the applicant (if they share the same place of residence) and shares the applicant's livelihood.

- Based on income from the previous year of the application date (if documents are not issued as of the application date, the year before last)

- Asset held: Financial assets and real assets held for more than 6 months from the date of acquisition to the date of application for permanent residency

3. Basic Knowledge Requirements

- Completion of 5 Steps of the Social Integration Program

- Score more than 60/100 points in the comprehensive evaluation for Permanent Residency/Naturalization

- Exemption:

· A minor foreigner under the age of 15

· A minor over 15 years of age and currently attending a regular educational institution

· A person who meets the requirements for permanent residence status eligible for exemption

· Those who have completed a regular doctoral course in Korea and obtained a degree from a graduate school in Korea

※ Loss of Permanent Residency status:

Do not enter Korea within the re-entry exemption period (within 2 years from the date of departure) or re-entry permit period

※ Cancellation of Permanent Residency status

- Acquired Permanent Residency status through false or fraudulent means

- Commits a crime and sentenced to imprisonment or imprisonment for more than 2 years

- Sentenced to imprisonment or imprisonment for violating Korean law within the past 5 years and the total length of the confirmed sentence is 3 years or more.

- If a person qualified for F-5-25 withdraws part or all of the deposited amount within 5 years from the date of receiving permanent resident status.

- Applies to the following reasons for Deportation

· Insurrection, Foreign aggression

· If a person is released after being sentenced to imprisonment or imprisonment for more than 5 years for the following crimes:

(Murder, rape, molestation, robbery, sex crime, drug crime, violation of the National Security Act, public health crime, Kidnapping or Abduction, habitual robbery and theft, repeat offender of robbery and injury, revenge crime, Organization of Criminal Groups)

· Violation/abetment/aiding of illegal immigration

- Against Korea’s national interests in terms of national security, diplomatic relations, and national economy.

공통요건 1. 한국 법령준수 등 품행단정 요건 - 국내범죄: 1. 강력범죄(살인, 약취, 유인, 인신매매, 강간, 강도, 범죄단체 조직) 형 선고받은 자, 2. 금고이상의 실형 선고받고 종료나 면제일로부터 5년 내의 자, 3. 금고이상의 집행유예 선고받고 확정일로부터 5년 내의 자, 4. 벌금형의 선고를 받고 벌금을 납부한 날부터 3년 내의 자, 5. 여권/사증/입국허가서/입국허가서 위반한 날부터 5년 이내의 자, 6. 신청일부터 최근 5년간 출입국관리법 3회 이상 위반(과태료 처분은 제외)한 자, 7. 강제퇴거명령으로 출국한 뒤 7년/출국명령으로 출국한 뒤 5년 이내의 자, 8. 최근 3년간 출입국관리법 위반으로 500만원 이상의 범칙금 처분/합산 범칙금 700만원 이상인 자, 9. 강제퇴거 대상이지만 체류허가 받은 사람으로 체류허가 결정일부터 5년 이내의 자 - 해외범죄: 1. 외국에서의 강력범죄, 협박, 공갈, 사기, 3회 이상의 음주운전, 보이스피싱, 마약범죄로 형의 선고를 받은 자, 그 외의 범죄로 금고 이상의 형을 선고 받은 사람은 선고일로부터 10년 이내의 자 2.국적국, 최근 5년 이내 1년 이상 연속 거주한 경우 그 국가 3.면제요건: 한국 출생, 신청일 기준 만 14세 미만이거나 14세 미만에 입국해서 14세 이후 해외에서 6개월 이상 연속체류하지 않은 경우, 사증발급 시 해범경을 제출하고 사증발급일로부터 3개월 내 영주권(F-5) 자격 변경신청하는 경우, 발급 대상 국가기준에 따라 연령/거주요건 미충족으로 서류발급 불가능, 천재지변, 전쟁등의 발급불능 사유, 신청일까지 국내에서 10년 이상 계속 합법체류한 자, 6개월 이상 체류했으나 체류국 발급에 연령/거주요건 불충족으로 발급이 어려운 경우 - 준법시민교육 시행: 2. 생계유지 요건(F-5-10, F-5-13의 경우에는 신청인만을 소득주체로. 소득 or 자산 요건 하나 충족 이상) : 신청인, 가족(배우자(사실혼 제외), 미성년 자녀, 부모(배우자의 부모 제외))중 신청인의 소득산정기간동안 신청인과 계속 동거(체류지를 함께 한 경우)하면서 생계를 같이 하는 사람 신청일 전년도 소득 기준(신청일 기준으로 서류가 발급되지 않을 경우, 전전년도) 자산보유: 취득일로부터 영주자격 신청일까지 6개월 이상 계속 보유하고 있는 금융자산과 실물자산(21년3월말 기준 순자산 4억 1,452만원) 연간소득 비교기준은 전년도 GNI 3. 기본소양 요건 - 사회통합프로그램 5단계 이수 - 영주용/귀화용 종합평가에서 60점/100점 이상 득점 - 면제: 만 15세 미만 미성년 외국인, 만 15세 이상 미성년으로 정규 교육기관에 재학중, 면제에 해당하는 영주자격 받을 요건 갖춘 자, 국내 대학원에서 정규 박사과정 이수 및 학위취득한 자 영주자격 상실: 재입국면제 기간(출국한 날부터 2년 이내) 또는 재입국허가 기간까지 한국에 입국하지 않은 경우 영주자격 취소 1.거짓이나 부정한 방법으로 영주자격을 취득한 경우 2.법률에 규정된 죄를 범하여 2년 이상의 징역 또는 금고의 형이 확정된 경우 3.최근 5년 이내 한국의 법률을 위반하여 징역 또는 금고의 형을 선고받고 확정된 형기의 합산기간이 3년 이상인 경우 4.F-5-25의 자격자가 예치한 금액의 일부 또는 전부를 영주자격을 받은 날부터 5년 내에 인출한 경우 5.다음 강제퇴거 사유에 해당 -내란, 외환 -다음의 죄로 5년 이상의 징역 또는 금고의 형을 선고받고 석방된 경우 (살인, 강간, 추행,강도죄,성범죄,마약범죄,국가보안법,보건범죄,약취유인,상습강도절도,강도상해 재범자,보복범죄, 마약사범, 범죄단체 구성) -밀입국관련 위반/교사/방조 6.국가안보, 외교관계 및 국민경제 등에 있어서 한국의 국익에 반하는 행위
